Please read these Terms and Conditions ("Terms") carefully before using the Productivitism mobile application (the "App") operated by us. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the developers of Productivitism ("we", "us", "our"). Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

If you are using the App on an Apple device, additional terms in the Apple Standard End User License Agreement (EULA) also apply.

2. Description of Service

Productivitism is a gamified productivity application that allows users to:

• Create and manage characters with customizable stats and appearances.
• Track daily habits, streaks, and progress logs.
• Create and complete tasks (quests) with difficulty ratings and XP rewards.
• Record voice memos associated with tasks or characters.
• Use a focus timer (The Sanctuary) with ambient soundscapes.
• Optionally sync data across devices via a cloud account.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

3. User Accounts

You may use the App as a guest without an account. If you create an account, you agree to:

• Provide accurate and complete registration information.
• Keep your account credentials confidential.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

We reserve the right to terminate accounts that violate these Terms, contain fraudulent information, or are inactive for extended periods.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or extract the source code of the App.
• Use automated tools, bots, or scripts to access or interact with the App.
• Introduce viruses, malware, or any other harmful code into the App.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the App to harass, abuse, or harm others.
• Misrepresent your identity or affiliation when contacting us.

5. User Content

You retain ownership of all content you create within the App (tasks, habits, characters, voice memos). By syncing content to our servers, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit your content solely for the purpose of providing the App's services to you.

You are solely responsible for the content you store within the App. We do not monitor user content but reserve the right to remove content that violates these Terms.

6. Intellectual Property

The App, including its code, design, graphics, pixel art, sounds, characters, and text content, is owned by us and protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not copy, modify, distribute, sell, or create derivative works of any part of the App without our prior written consent.

7. In-App Purchases & Subscriptions

The App is currently free during the Early Access period. We may introduce optional in-app purchases or subscription plans in the future. If we do:

• Purchases will be processed through the Apple App Store or Google Play Store.
• Subscriptions will auto-renew unless cancelled before the renewal date.
• Refunds are subject to the policies of the applicable app store.
• We reserve the right to change pricing with reasonable notice.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any data stored in the App will not be lost.

9. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $10, whichever is greater.

10. Third-Party Links & Services

The App may contain links to third-party websites or services (such as social media profiles). These are provided for convenience only. We have no control over, and assume no responsibility for, the content or practices of any third-party sites.

11. Termination

We may terminate or suspend your access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting it within the App's Settings. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it may be submitted to binding arbitration or the courts of the applicable jurisdiction.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Effective Date" at the top of this page. Continued use of the App after changes constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.
